Terms of Service

Beta Notice: CUE PT is currently operating as a beta service. These terms are provided as a good-faith starting point and should be reviewed by a qualified solicitor before public launch.

1. About CUE PT

CUE PT LTD ("we", "us", "our") operates an online marketplace that connects clients seeking personal training services with independent personal trainers ("PTs"). We are registered in England and Wales under company number 17114959, with registered office at 71–75 Shelton Street, Covent Garden, London, WC2H 9JQ. By using our platform at cue-pt.com, you agree to these Terms of Service ("Terms").

2. Eligibility

You must be at least 18 years old to use CUE PT. By creating an account you confirm that all information you provide is accurate and that you have the legal capacity to enter into a binding agreement.

3. Our Role as a Marketplace

CUE PT is a technology platform only. We do not employ personal trainers, and we are not a party to the training agreement between a client and a PT. When you book a session through CUE PT:

  • The PT is an independent contractor, not a CUE PT employee or agent
  • The PT is solely responsible for the quality and safety of training services
  • CUE PT is not liable for any injury, loss, or damage arising from a session
  • Any dispute about the quality of a session is between the client and PT directly

4. Accounts

You are responsible for maintaining the security of your account and all activity that occurs under it. You must not share your login credentials or allow others to access your account.

We reserve the right to suspend or terminate accounts that violate these Terms, engage in fraudulent activity, or behave in a way that harms other users or the platform.

5. Bookings and Payments

5.1 Deposits

When you book a session, a deposit of 10% of the total session fee is charged at the time of booking. This deposit is used to secure your session and is deducted from the final payment.

5.2 Final Payment

The remaining 90% of the session fee is charged automatically to your saved payment method upon session completion. By completing a booking, you authorise CUE PT (via Stripe) to charge this amount once the session ends.

5.3 Platform Fee

CUE PT charges a platform fee of 10% of the session price. This is deducted from the amount paid to the PT and is reflected in the PT's listed rate. Clients pay the displayed price only - no additional platform charges apply to clients.

5.4 Cancellations

  • More than 24 hours before the session: Full deposit refund
  • Within 24 hours of the session: Deposit is forfeited. The PT is compensated for their time.
  • PT cancellation: Full deposit refund regardless of timing.

5.5 No-Shows

If a client fails to attend without cancelling, the deposit is forfeited and paid in full to the PT as a cancellation fee. If a PT fails to attend, the client receives a full refund of their deposit.

6. Personal Trainer Obligations

By offering services on CUE PT, PTs agree that they:

  • Hold a current, valid personal training qualification (Level 3 or equivalent)
  • Hold valid public liability insurance covering personal training services
  • Are registered as self-employed or operating through a valid business entity
  • Are responsible for their own tax obligations
  • Will maintain accurate profile information, including qualifications and certifications
  • Will behave professionally and provide services as described

7. Client Obligations

Clients agree that they:

  • Will disclose any medical conditions or injuries relevant to training before a session
  • Participate in training at their own risk and have assessed their own fitness to do so
  • Will not attend a session if unwell in a way that may affect the PT or others
  • Will treat PTs with respect and professionalism at all times — before, during, and after a session
  • Will not engage in threatening, harassing, sexually inappropriate, or otherwise harmful conduct toward a PT
  • Will not attempt to arrange bookings or payments outside the CUE PT platform

A PT has the right to refuse to start, or to end, a session where a client's conduct makes it unsafe or inappropriate to continue. This does not entitle the client to a refund. PTs may report clients to CUE PT's Trust & Safety team, and accounts found to have breached these obligations may be suspended or permanently removed.

8. Prohibited Conduct

You must not:

  • Use the platform for any unlawful purpose
  • Attempt to circumvent the platform by arranging bookings or payments outside CUE PT
  • Submit false reviews or misrepresent yourself or your qualifications
  • Harass, threaten, or discriminate against other users
  • Attempt to gain unauthorised access to any part of the platform
  • Upload content that is offensive, misleading, defamatory, or otherwise unlawful

8A. Content Standards and Reporting

All content on the platform — including PT profiles, gallery images, class descriptions, and reviews — must comply with applicable law and these Terms. CUE PT may remove content that breaches these standards and may suspend or terminate accounts where the breach is material.

If you encounter content you believe breaches these standards, you can report it using the Report link on PT profiles, class pages, or individual reviews. CUE PT will investigate all reports and take appropriate action. We are not able to share the outcome of individual investigations. Safeguarding reports are prioritised and reviewed promptly. This reporting mechanism is provided in accordance with the UK Online Safety Act 2023.

9. Limitation of Liability

To the fullest extent permitted by law, CUE PT shall not be liable for:

  • Any injury, loss, or damage sustained during or as a result of a training session
  • The conduct, qualifications, or actions of any PT on the platform
  • Loss of earnings, data, or business arising from use of the platform
  • Any indirect or consequential losses

Nothing in these Terms excludes liability for death or personal injury caused by our negligence, fraud, or any other liability that cannot be excluded by law.

10. Intellectual Property

All content on the CUE PT platform - including the logo, design, software, and text - is the property of CUE PT and may not be copied, reproduced, or distributed without our written permission.

11. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes by email or via a notice on the platform. Continued use of CUE PT after changes take effect constitutes your acceptance of the revised Terms.

12. Governing Law

These Terms are governed by the laws of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.
